Effective Date: January 1, 2026
These Terms and Conditions ("Terms") govern your use of the website located at jonesboromasonry.com (the "Site") and any services provided by Jonesboro Masonry & Concrete ("we," "us," or "our"). By accessing the Site or engaging our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.
By using this Site or requesting services from Jonesboro Masonry & Concrete, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of a business or property owner, you represent that you are authorized to accept these Terms on their behalf.
Jonesboro Masonry & Concrete provides residential and commercial masonry contracting services, including but not limited to foundation repair, chimney repair, tuckpointing, brick repair, driveway pavers, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, walkway construction, and related masonry work in Jonesboro, Arkansas and surrounding areas.
All services are subject to a written agreement between Jonesboro Masonry & Concrete and the customer prior to work beginning. Information on this Site is for general reference only and does not constitute a binding offer or guarantee of service availability.
Any estimate provided by Jonesboro Masonry & Concrete is based on information available at the time of the on-site assessment. Estimates are not binding quotes unless confirmed in writing and signed by both parties. Actual costs may vary if conditions change, if concealed damage is discovered during work, or if the scope of work is modified by the customer.
Estimates are valid for 30 days from the date issued unless otherwise stated in writing. We reserve the right to adjust pricing after 30 days due to changes in material costs or labor availability.
Any additional work requested beyond the original scope will be estimated separately and requires written approval before work proceeds.
Scheduling is confirmed when both parties have agreed to a written work agreement and any required deposit has been received. We reserve the right to reschedule jobs due to weather conditions, material availability, or other circumstances outside our control. We will provide as much advance notice as practicable in such situations.
If you need to cancel or reschedule, please notify us at least 48 hours before the scheduled start date. Cancellations made with less than 48 hours notice may result in a forfeiture of any deposit paid, depending on the materials already ordered or work already performed.
If Jonesboro Masonry & Concrete cancels a confirmed job without cause, any deposit paid will be refunded in full.
Payment terms are specified in the written work agreement for each project. A deposit may be required before work begins; the deposit amount and structure will be stated in the agreement. Final payment is due upon completion of the work and before our crew leaves the property, unless otherwise agreed in writing.
Accepted payment methods will be specified in your agreement. Invoices not paid within 10 days of the due date may be subject to a late fee. Jonesboro Masonry & Concrete reserves the right to pursue collection of unpaid balances, including reasonable attorney fees and court costs, to the extent permitted by Arkansas law.
Any warranty on workmanship will be stated in the written work agreement for your specific project. Where a warranty is provided, it covers defects in our workmanship under normal use conditions. It does not cover damage caused by acts of nature, subsequent modifications by others, improper maintenance, normal wear and tear, or pre-existing conditions not identified during the initial assessment.
Material warranties, if any, are provided by the manufacturer and are passed through to the customer as permitted. Jonesboro Masonry & Concrete makes no representations beyond what is stated in the written work agreement.
The Site and its content are provided "as is" without any warranty of accuracy, completeness, or fitness for a particular purpose. We do not warrant that the Site will be error-free or uninterrupted.
To the fullest extent permitted by applicable law, Jonesboro Masonry & Concrete shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or the services we provide, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to a specific project shall not exceed the total amount paid by you to Jonesboro Masonry & Concrete for that project.
You are responsible for providing accurate information about the property and work conditions, ensuring safe access to the work area, disclosing any known hazards (such as underground utilities, asbestos, or structural instability), and obtaining any required consent from property owners or associations before work begins.
Failure to disclose known hazards or conditions that affect the safety or scope of the work may void any warranty and result in additional charges for corrective work.
If a dispute arises between you and Jonesboro Masonry & Concrete relating to the Site or our services, we encourage you to contact us first at the information below. We will make a good-faith effort to resolve the dispute informally.
If informal resolution is not reached within 30 days, the dispute shall be resolved by binding arbitration in Jonesboro, AR, in accordance with the rules of the American Arbitration Association, unless both parties agree in writing to a different process. You waive any right to a jury trial for claims covered by this provision.
This arbitration provision does not prevent either party from seeking injunctive or emergency relief from a court of competent jurisdiction to prevent irreparable harm.
These Terms and any dispute arising out of your use of the Site or our services shall be governed by the laws of the State of Arkansas, without regard to its conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Jonesboro, Arkansas.
